The use of Smart-X Software Solutions Ltd. (“Smart-X”) website (“Website”) is conditioned upon the acceptance of the terms and conditions contained in this Privacy Statement by the visitor of the Smart-X Website (“User”). This privacy statement applies to Smart-X’s Website. It does not apply to Smart-X’s services and products that have their own privacy statements.

This Privacy Statement is a part of and is incorporated by reference into the Terms of Use of the Smart-X Website. This Privacy Statement constitutes a legally binding agreement between the User and Smart-X. This Privacy Statement lists Smart-X’s current policy, but, as noted below, this Privacy Statement may be adjusted from time to time according to Smart-X’ sole discretion. By using Smart-X’s Website, User expressly agrees to this Privacy Statement. If the User does not agree to any of the provisions of this Privacy Statement it shall refrain from using, under any circumstances, Smart-X’s Website.

Automatic and Non-Interactive Data Collection during Website visit

Each time User accesses Smart-X’s Website, and each time a file is accessed, a protocol file is stored. The storage of this data is used for internal, system-based and statistical purposes only. Each request stores the following individual information:

• The page from which the request is sent (if the browser forwards the same)
• Name of the requested file, date and time of the request
• Transferred data volume
• Notification if the request was successful
• Description of the browser type used (if the browser forwards the same)
• IP address of the computer forwarding the request

Interactive Data Collection during Website visit

User should be aware that portions of this Website contain functions for collecting and/or receiving User’s personal information, including User’s name and email address, information about User’s product purchases, any credit information provided and the User’s history of accesses this Website.

Smart-X may hire other companies (vendor) to provide limited services on its behalf, such as processing transactions. Those service providers shall be allowed to obtain only the personal information they need to deliver the service. The service providers shall be required to maintain the confidentiality of the information and shall be prohibited from using it for any other purpose than for providing the service to Smart-X. Smart-X and its affiliates may access or disclose information about the User, including the content of the User’s communications, in order to comply with the law or respond to lawful requests or legal process.

Analytics and Advertising

Smart-X’s Website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on the User’s computer, to help the website analyze how users use the site. The information generated by the cookies regarding the User’s use of the Website (including User IP address) is transmitted to and stored by Google. Google use this information for the purpose of evaluating the User’s use of the website, compiling reports regarding the Website activity for Website operators and providing other services relating to the Website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate the User’s IP address with any other data held by Google. The User may refuse the use of cookies by selecting the appropriate settings on its browser, however please note that if the User refuse the use of cookies the User may not be able to use the full functionality of the Website. By using this Website, User consent to the processing of data about the User by Google in the manner and for the purposes set out above.

The Google Analytics tracking code implemented on this Website supports Display Advertising. Google Analytics for Display Advertising is used on this Website in the form of Remarketing. Third-party vendors, including Google, will show Smart-X ads on sites across the Internet. Smart-X and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize and serve ads based on the User’s past visits to this Website. The User can opt out of Google Analytics for Display Advertising and customize Google Display ads using the Ads Preferences Manager.

The following Google AdWords features are used on the Website:
• Remarketing
• Interest Categories
• Similar Audiences
• Other types of interest-based advertising

Smart-X uses these features of Google Adwords to target past visitors across the internet or visitors with specific interest profiles based on their internet usage. Smart-X does not collect personally identifiable information (PII) through its cookies, remarketing lists, or any other anonymous identifiers.

The User may, at any time, opt-out and decline the automatic and non-interactive collection and storage of its data.

It should also be noted that if the User does not want any data regarding its visits to Smart-X’s Website to be collected by Google Analytics, the User can install the Google Analytics Opt-out Browser Add-on. The add-on maintains the User’s visit anonymous and prohibits any data from being sent to Google Analytics.

Use of User Information

Smart-X reserves the right to compile, save and use within the scope of Smart-X’ activities, any and all User data (registration data, use history, etc.). Smart-X also reserves the right to analyze the User data, except any credit information provided by the User. Smart-X, its affiliates, agents, and contractors/vendors intend to use such User data for internal purposes only, including without limitation, for the purposes of providing the User support services, responding to User’s information requests, and for contacting the User. Additionally, Smart-X may disclose your personal information in association with law enforcement, fraud prevention, a subpoena, or other legal action; as required by law, rule, or regulation; or if Smart-X reasonably believes it is required to protect Smart-X, its customers, or the public. 

Choice/Opt-Out

Smart-X may send the User periodically information regarding Smart-X and its products. If the User receives such information and does not wish to continue receiving such information, the User should contact Smart-X at the following email address: webmaster@Smart-X.com, and inform Smart-X that the User no longer wishes to receive such information. Alternatively, the User can simply reply to an email from Smart-X and type “REMOVE” in the subject line. 

Disclosure of User Information

Smart-X shall, control the User’s information, to the extent possible, and, except as otherwise set forth herein, shall refrain from disclosing such information to any third parties. However, in the event that a disclosure of any of the User’s information by Smart-X is required by law, rule, or regulation, for law enforcement reasons, or for the safety of the Smart-X community, Smart-X may disclose such information without the consent of the User. 

Cookies

A “cookie” is a piece of data stored on User’s hard drive containing information about the User that can later be read by a web server in the domain issued the cookie to the user. Smart-X may use cookies in order to collect certain information about the User, such as IP addresses (e.g., whether the User is logged on from a .com, .gov, or .edu domain), domain names (the Internet address of a computer), and type of computer and operating system being used. Smart-X may collect such information in order to better operate the Website so as to enhance the User’s use of the Website. By using cookies, Smart-X is able to recognize the User when the User revisits the Website, and it is able to remember certain information about the User, such as User’s contact information. Depending on the type of browser the User is using, it may be set to alert User of cookies. The User shall not be obligated to accept all the cookies sent by Smart-X’s Website; however, depending on the particular cookie the User rejects, the User may not be able to use some of the features in the Website if a particular cookie is rejected. 

Third Party Sites

The Website may from time to time include, links to third party sites, which Smart-X does not own or control and that are controlled by third parties. These links are for convenience only. If the User choose to use third party links or moves to the third party sites, Smart-X shall not be held responsible for the availability, content, data collection, utilization of data, use of cookies, or otherwise by the third party sites. Smart-X has no access to the third party sites or information collected by them and no control over any third party cookies. If the User has any questions about third parties’ use of cookies, their gathering of information, or otherwise, the User should contact such third parties directly. 

Spam

Smart-X is concerned about controlling unsolicited commercial e-mail, or “spam”. Therefore, Smart-X will not sell, lease or rent its Users’ e-mail lists to third parties. However, it should be emphasized that there is no technology that will totally prevent the sending and receiving of unsolicited e-mail.

Security

Smart-X is committed to protecting the information concerning and submitted by the User.

Smart-X uses reasonable security measures to safeguard the information from unauthorized access, use or disclosure. Despite the security measures employed by Smart-X, Users should be aware that it is impossible to guarantee absolute security with respect to information sent through the Internet, and User agrees and accepts the risks associated with the same. 

When we transmit highly confidential information (such as a credit card number or password) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

If a password is used to help protect the users’ accounts and personal information, it is the Users’ sole responsibility to keep their password confidential. The Users should not share this information with anyone. If the Users share a computer with anyone they should always log out before leaving a site or service to protect access to their information from subsequent users.

Modifications

This Privacy Statement and the Terms of Use of Smart-X’s Website constitute the entire agreement between the parties with respect to their subject matter and supersede any prior agreement or communication, either oral or written between the parties with respect to their subject matter and no agreements or understandings varying or extending thee same shall be binding upon either party. Smart-X reserves the right to modify this Privacy Statement without prior notice. In the event Smart-X updates or modifies this Privacy Statement, Smart-X shall endeavor to post such updates or modifications on this Website following any such modifications and indicate the date in which this Privacy Statement was updated at the top of the statement. In the event that Smart-X will wish to implement any material changes to this Privacy Statement or to the manner in which the Users’ personal information will be used, Smart-X shall notify the Users either by prominently posting a notice of such changes prior to the implementation of the change or by directly sending the Users a notification regarding the change. However, theUser is advised to review this Privacy Statement occasionally, or at least every thirty (30) days. The User’s continued use of this Website subsequent to Smart-X’ notice of modification of this Privacy Statement shall constitute the User’s acceptance of the modified Privacy Statement.
